These Terms & Conditions (“Terms”) govern your relationship with SwiftTryo Financial Bank (“SwiftTryo,” “we,” “us,” or “our”) and your use of our accounts, cards, payment services, lending products, digital banking channels, and any related services (collectively, the “Services”). By opening or using any Service, you agree to these Terms and all documents incorporated by reference.


1) Definitions

  • Account: Any deposit, savings, current, term, loan, or e‑money account held with SwiftTryo.
  • Digital Channels: SwiftTryo mobile app, web banking, APIs, and any electronic interface we provide.
  • Payment Instrument: Debit/credit/prepaid cards, tokens, virtual cards, and other credentials we issue.
  • Credentials: Your username, passwords, PINs, biometrics, OTPs, security questions, and device bindings.
  • Business Day: A day banks are open in the applicable jurisdiction, excluding weekends/public holidays.

2) Acceptance of Terms

You accept these Terms when you (a) apply for or open an Account, (b) activate a Payment Instrument, or (c) access/continue using the Services. If you do not agree, do not use the Services.


3) Eligibility & Onboarding

  • You must be of legal age and have full legal capacity.
  • You authorize SwiftTryo to conduct KYC/AML checks, sanctions screening, credit referencing, and identity verification (including biometric verification where permitted).
  • We may approve, reject, or limit your application at our discretion and without obligation to disclose reasons, except where required by law.

4) Your Information & Privacy

  • We collect and process your personal data to provide the Services, manage risk, meet legal obligations, and improve our offerings.
  • Our processing is governed by the SwiftTryo Privacy Notice, incorporated by reference.
  • You must ensure your data is accurate and up to date and notify us promptly of changes (address, tax residency, contact details).
  • We may share data with affiliates, service providers, card schemes, correspondent banks, credit bureaus, tax authorities, and regulators as permitted/required by law.

5) Accounts

5.1 Opening & Use

  • Account types, features, and eligibility criteria are described in product disclosures.
  • You must use Accounts for lawful purposes and in accordance with the stated purpose (e.g., personal vs. business).
  • We may set limits (balance, transaction, velocity), hold funds, or decline transactions to manage risk or comply with law.

5.2 Interest & Fees

  • Interest (if any) and the method of calculation are described in the Product Sheet and Fee Schedule.
  • We may change rates and fees per Section 13 (Changes to Terms).

5.3 Statements & e-Statements

  • We provide periodic statements via Digital Channels and/or email. Please review promptly and report discrepancies within 30 days.

5.4 Dormancy & Unclaimed Balances

  • Accounts may be classified dormant after inactivity thresholds. Fees and escheatment/unclaimed money rules may apply as required by law.

6) Payments & Transfers

  • Payment execution times depend on cut‑off times, rails/schemes, and compliance checks.
  • We may decline, delay, or reverse payments due to insufficient funds, sanctions/AML flags, technical issues, or legal/regulatory requirements.
  • You are responsible for accurate payee details; we are not liable for losses due to incorrect information you provide.
  • Chargebacks/recalls are subject to the rules of the relevant scheme or payment system.

7) Cards & Payment Instruments

  • Keep Physical and Virtual Cards secure; do not share card numbers, CVV, PIN, or OTPs.
  • Report loss/theft/suspected compromise immediately via our support channels.
  • Card use is subject to scheme rules (e.g., Visa/Mastercard) and transaction limits.
  • We may replace, suspend, or cancel a card at any time for security/risk reasons.

8) Digital Channels & Security

  • You agree to keep Credentials confidential and devices updated with current security patches.
  • Enable device‑level security (biometric, PIN) and multi‑factor authentication (MFA) where available.
  • You are responsible for transactions authenticated using your Credentials or devices unless (i) you notified us promptly of compromise and (ii) we failed to act with reasonable care.
  • We may conduct security checks, require re‑authentication, or block access if suspicious activity is detected.

9) Authorized Users & Mandates (Business Accounts)

  • You may appoint authorized users/signatories with defined powers.
  • You are responsible for their actions and must manage mandates within the Digital Channels or via formal instructions.

10) Errors, Unauthorized Transactions & Disputes

  • Notify us immediately (and in any case within [X] days per product rules) of suspected errors or unauthorized transactions.
  • We will investigate and provide a resolution or provisional credit per applicable law/scheme rules.
  • We may require police reports, affidavits, or additional documents to process claims.

11) Fees, Charges & Currency Conversion

  • Fees and charges are set out in the Fee Schedule.
  • Currency conversions use schemes/networks or SwiftTryo rates plus any markup disclosed at the point of use.
  • Third‑party fees (intermediary banks, ATM operators) may apply and are outside our control.

12) Service Availability & Maintenance

  • We strive for high availability but do not guarantee uninterrupted service.
  • Planned maintenance will be notified where practicable; emergency maintenance may occur without notice.
  • We are not liable for outages caused by third‑party networks, utilities, or force majeure (see Section 22).

13) Changes to Terms, Fees & Services

  • We may update these Terms, the Fee Schedule, and product features.
  • Material changes will be notified via Digital Channels/email at least [30] days in advance unless law allows shorter notice (e.g., security/AML reasons).
  • Continued use after the effective date constitutes acceptance. You may close your Account before changes take effect.

14) Your Responsibilities

  • Provide accurate information and cooperate with our compliance requests.
  • Use the Services for lawful purposes; do not engage in prohibited activities (illegal goods/services, fraud, IP infringement, gambling where restricted, sanctions violations, etc.).
  • Maintain adequate device and network security and update your contact details.

15) Our Rights (Set‑off, Lien & Withholding)

  • We may set off sums you owe us against balances in your Accounts (including joint or multi‑currency accounts, subject to law).
  • We may place holds or withhold funds to investigate suspicious activity or comply with legal orders.
  • We may exercise a banker’s lien over assets in our possession to secure obligations you owe us.

16) Sanctions, AML/CFT & Compliance

  • You confirm you are not a sanctioned person and will not use the Services for sanctioned activities.
  • We may screen transactions, counterparties, and your data against sanctions lists and monitor for suspicious activity.
  • We may block, decline, or report transactions and freeze or close Accounts to comply with laws and regulatory obligations.

17) Tax Compliance (FATCA/CRS and Local Laws)

  • You must provide self‑certifications, tax identification numbers, and updates to your tax status.
  • We may report account information to tax authorities under FATCA/CRS and applicable local tax laws.
  • We may withhold taxes when required by law.

18) Intellectual Property & License

  • All content, trademarks, software, and materials in the Services are owned by SwiftTryo or licensed third parties.
  • We grant you a limited, revocable, non‑exclusive, non‑transferable license to use the Digital Channels for your own lawful use.

19) Third‑Party Services

  • The Services may integrate with third‑party tools (e.g., payment schemes, wallets, app stores).
  • We are not responsible for third‑party content, terms, policies, or outages.

20) Limitation of Liability

  • To the maximum extent permitted by law, SwiftTryo is not liable for:
    • indirect, incidental, punitive, or consequential losses;
    • loss of profits, data, business, or goodwill;
    • third‑party failures (networks, schemes, correspondent banks) outside our reasonable control.
  • Nothing in these Terms limits liability for fraud, gross negligence, or liability that cannot be excluded by law.

21) Indemnity

You agree to indemnify and hold harmless SwiftTryo, its affiliates, and personnel from claims, losses, damages, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, unlawful use, or misuse of the Services.


22) Force Majeure

We are not responsible for failure or delay caused by events beyond our reasonable control, including natural disasters, epidemics, acts of war/terrorism, labor disputes, utility failures, or regulatory actions.


23) Suspension & Termination

  • We may suspend or terminate any Service or Account with notice where required by law, including for security, risk, or compliance reasons.
  • You may close your Account after settling all outstanding obligations.
  • On termination, we will return available balances (net of fees/charges, set‑off, or legal holds) via an acceptable method.

24) Complaints & Dispute Resolution

  • Contact us first at contact@swifttryofinancial.com or  we aim to acknowledge within 24hrs and resolve within 1 days

25) Communications & E‑Signatures

  • You consent to receive electronic communications (statements, notices, disclosures) via Digital Channels/email.
  • Electronic signatures and click‑wrap acceptances have the same legal effect as handwritten signatures where permitted.

26) Governing Law & Jurisdiction

These Terms are governed by the laws of [Country/State], and you submit to the exclusive/non‑exclusive jurisdiction of the courts of [City/Country]. Conflict‑of‑laws principles do not apply. Mandatory consumer protections in your place of residence may still apply.


27) Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or novate these Terms to an affiliate or successor with notice to you.


28) Severability & Waiver

If any provision is unlawful or unenforceable, the remaining provisions remain in effect. Failure to exercise any right does not constitute a waiver.


29) Entire Agreement

These Terms, together with the Privacy Notice, Fee Schedule, Product Sheets, and any Supplemental Terms (e.g., cardholder agreement, loan agreement, API terms), form the entire agreement between you and SwiftTryo regarding the Services.
